Bail and Bondsman

A person arrested for a crime can remain out of jail while waiting for the trial to start as long as he or she posts bail. Bail is the amount of money set by the court to serve as a guarantee that the defendant will appear in court once the trial begins. If he/she violates this condition, he/she forfeits the money.

If the defendant is unable to post bail due to financial difficulties, he or she is allowed to secure the services of a bondsman. The fee is usually 12% of the bail amount. In exchange for this fee, the bondsman will act as a surety – signing the bond and assuring the court that payment of the entire bond amount will be the bondsman’s responsibility.
