All sex offenders are required by law to register their information in the state and national sex offender databases. Everyone is given access to these registries in the interest of public safety and awareness. Persons who have been found guilty of a sexually motivated offense such as rape, prostitution, and child molestation are classified as sex offenders. To find out if any sex offenders reside in your neighborhood in Kentucky, you can use the state’s sex offender registry here.
Please be advised that not all sex offenders comply with the law. There may be information in the registry that is inaccurate. For example, some offenders have not updated their address after moving. Some offenders may have listed their block as their complete address.
Bail and Bondsman
Bail means that an individual accused of a crime is allowed by the court to temporarily stay out of jail while waiting for the trial to start. The court grants its permission with the understanding that the individual will not miss any of his scheduled court appearances. Some types of bail will require the payment of money or property aside from the defendant’s promise to be present at the trial. If he fails to keep his promise, the money or property is forfeited to the court.
When some defendants are unable to post bail because of monetary concerns, a bondsman can be hired to serve as a guarantee. This means that the bondsman will be the one that will pay the bail if the defendant does not appear in court. To hire a bondsman, you will need to pay a non-refundable fee that is usually set at 10% of the bail amount.
The practice of commercial bail bonding is considered illegal in Kentucky. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). If a bondsman from another state is planning on arresting a fugitive who has fled to Kentucky, he will need to first obtain a warrant. Ky. Rev. Stat. § 440.270.
