Bail and Bondsman

Bail means that an individual accused of a crime is allowed by the court to temporarily stay out of jail while waiting for the trial to start. The court grants its permission with the understanding that the individual will not miss any of his scheduled court appearances. Some types of bail will require the payment of money or property aside from the defendant’s promise to be present at the trial. If he fails to keep his promise, the money or property is forfeited to the court.

When some defendants are unable to post bail because of monetary concerns, a bondsman can be hired to serve as a guarantee. This means that the bondsman will be the one that will pay the bail if the defendant does not appear in court. To hire a bondsman, you will need to pay a non-refundable fee that is usually set at 10% of the bail amount.

The practice of commercial bail bonding is considered illegal in Kentucky. Ky. Stat. § 431.510 (outlawing commercial bail bond industry); see Stephens v. Bonding Assoc. of Kentucky, 538 S.W.2d 580 (Ky 1976) (upholding statute). If a bondsman from another state is planning on arresting a fugitive who has fled to Kentucky, he will need to first obtain a warrant. Ky. Rev. Stat. § 440.270.

Hopkinsville Couple Arrested on Meth Charges

11/21/2017

Detectives with the McCracken County Sheriff’s Department’s Drug Division arrested a Hopkinsville, Kentucky couple on Monday night on drug charges and seized a large quantity of Methamphetamine.

Detectives with drug division began a drug investigation earlier this month after receiving information that a Hopkinsville man, only known as “Terp” was supplying McCracken County residents with Methamphetamine to use/sell.

During the course of the investigation detectives identified “Terp” as Kevin J. Terpening, 43 of Hopkinsville KY as a source of supply for Methamphetamine in McCracken and other Western Kentucky Counties. The investigation revealed that Terpening had an extensive criminal history. Kevin Terpening had prior convictions for burglary, bail jumping, fleeing or evading the police, wanton endangerment, possession of a handgun by a felon, manufacturing Methamphetamine 2nd offense, trafficking Methamphetamine and numerous other felony and misdemeanor offenses. Terpening had received a 20 year prison sentence in January of 2011 but was later released on parole.

Through a covert investigation, detectives learned that Terpening would be delivering a quantity of Methamphetamine to McCracken County at a local gas station located at 7050 Benton Road just off of I-24. Detectives conducted surveillance and observed Terpening and a female later identified as Melissa Cusano arrive the gas station. Both Terpening and Cusano were detained. Detectives located a small quantity of Methamphetamine on Cusano’s person and placed her under arrest. During a search of the passenger compartment of the truck detectives located approximately 10 grams of Crystal Methamphetamine and various items of drug paraphernalia. Detectives then located an additional 1.6lbs (629 grams) of Crystal Methamphetamine concealed in the spare tire of the truck. If sold by the gram, the seized Methamphetamine could have an estimated street value of more than $63,000.

Both Terpening and Cusano were arrested and lodged in the McCracken County Regional Jail.

The Sheriff’s Department was assisted by detectives with the Marshall County Sheriff’s Department and DEA Madisonville. The investigation is continuing.
