Bail and Bondsman
The money lodged with the court in exchange for the temporary release of a defendant from custody or jail is known as bail. Once bail is paid, the court will hold the money in its keeping to ensure that the defendant returns for his trial. If he doesn’t, he forfeits the money.
A defendant who cannot post bail due to financial difficulties can still get released from jail if he acquires the services of a bondsman. A bondsman requires 12% of the bail amount as his fee and this is non-refundable. Once hired, he will sign a bond with the court to get the defendant out of jail. If the defendant misses a court appointment, the bondsman is held liable for paying the entire bond amount.
