Etowah County is located in the state of Alabama. Originally Etowah was the southern part of DeKalb County. However, on December 7, 1866, Baine County was established and named after General David W. Baine of the Confederate Army, with its county seat at Gadsden. Later, in 1868, the county was abolished and Etowah County was created from the same territory. According to the U.S. Census Bureau, the county has a population of approximately 104,430 people and a total area of 549 square miles. In total area, it is the smallest county in Alabama, but one of the most densely populated counties in the country.

Some of the records maintained by the office of the Probate Judge include: mortgages on personal property; documents and instruments concerning condominiums; marriage license and military discharges; lis pendens; corporations and other forms of business organizations; petitions, decrees, or orders of bankruptcy; deeds, mortgages, deeds of trust, bills of sale; contracts or other documents purporting to convey any right, title, easement, or interest in any real estate or personal property; all assignments of mortgages; judgments and liens; and plats or maps.
